In compliance with Article 15 of the Federal Law on the Protection of Personal Data Held by Private Parties (“The Law”), you are hereby informed that QUIET LUXURY - ARTILA, with an address at: Plaza Meet Point, Manzana 109, Lote 8, Supermanzana 310, C.P. 77560, Cancún, Benito Juárez, Quintana Roo, will be responsible for the processing of your personal data. We will protect and safeguard your personal data to prevent damage, loss, theft, and unauthorized processing of your data. II. PURPOSE OF DATA PROCESSING:
The personal data collected by “Quiet Luxury - Artila”, whether in writing, via telephone, email, and/or any other means, may include but is not limited to the following non-sensitive personal data: Full Name; Place and Date of Birth; Official Identification Number; Signature; Occupation; Bank Account Information; Marital Status; Address; Home, Mobile, and Office Phone Numbers; Email; CURP; RFC. Additionally, we may request documents to verify the mentioned personal data. Personal data will be used for the following purposes: (i) To prepare deposit receipts; to enter into Purchase and Sale Contracts and/or Promise of Sale Contracts and/or Installment Purchase and Sale Contracts and/or Transfer of Domain Trust Contracts and/or Promise of Trust Contracts, for any of the Private Units of the “Artila Tulum” Housing Complex; (ii) to notify you of any situation related to or arising from the Contract entered into with the data owner; (iii) to inform you about new real estate developments and promotions of “Quiet Luxury - Artila”.
III. TRANSFER OF PERSONAL DATA:
Data may be transferred to Real Estate Intermediaries and Lawyers who, if necessary, are responsible for any judicial or extrajudicial collection; to the Notary Public before whom the public deed of transfer of domain is executed, and in compliance with the Federal Law for the Prevention and Identification of Operations with Illicit Resources, personal data may be provided to the Ministry of Finance and Public Credit; as well as to any other competent Authority that requires it by law.
IV. CONSENT FOR THE PROCESSING OF SENSITIVE, PROPERTY, AND FINANCIAL DATA:
You express your explicit consent for your personal data to be processed according to the terms and conditions of this “Privacy Notice”, unless you explicitly and in writing object to it, following the processes and forms described in this “Privacy Notice.”
V. REVOCATION OF CONSENT AND EXERCISE OF ACCESS, RECTIFICATION, CANCELLATION, OPPOSITION, AND REVOCATION RIGHTS:
All your personal data is processed according to the Federal Law on the Protection of Personal Data Held by Private Parties. Therefore, we inform you that you have the right to access your personal data held by “Quiet Luxury - Artila”, and to the details of their processing, as well as to rectify them if they are inaccurate or incomplete, cancel them if they are excessive or unnecessary for the purposes that justified their obtaining and oppose their processing for the purposes provided in this “Privacy Notice” through the email tulum_sales@quietluxury.com.mx, or a written request, presented from Monday to Friday, from 9:00 a.m. to 6:00 p.m., at the office of “Quiet Luxury - Artila”, which must include at least the following information:
- 1. Full name of the data owner.
- 2. Address of the data owner or email to communicate the response to the request.
- 3. Official documents that prove identity and/or authorization to represent them in the request (Voter ID issued by the Federal Electoral Institute, or passport, any of them must be valid).
- 4. Description of the data on which the right of Access; Rectification; Cancellation; Opposition (ARCO Rights) is to be exercised and the reasons justifying the action regarding your personal data.
- 5. Number and other identification data of the private unit that you are a Promising Buyer of.
VI. ONLINE PRIVACY POLICY
The information regarding the use of the “Quiet Luxury” website, created for the commercialization of the “Artila Tulum” Housing Complex, is described below: You should continuously review this Privacy Policy as it may change at any time at the discretion of the personal data administrators. When you enter the “Quiet Luxury” website, your internet address is recorded (this address is generally temporary and is assigned by your internet service provider when you connect), the type of operating system you use, and the type of browser software you use. The information we obtain is used to help us create a better experience for the users of our website. The whole process is carried out without knowing your name or allowing your identification, unless you decide to identify yourself explicitly. “Quiet Luxury” does not require you to provide personal data to use the website, unless it is necessary and this need is explicitly explained to you, and you consent by providing such information. Our contact forms may require you to enter your email address to register and address your comments, requests, questions, or suggestions, and to contact you if necessary. If you voluntarily provide us with personal data (general, financial, property, sensitive, or non-sensitive), “Quiet Luxury - Artila” ensures the strictest confidentiality in handling it. VII. DATA RETENTION PERIODS
We also inform you that the retention periods for your personal data in our database will be:
- 1. During the entire period of validity of the Contract entered into with you, regarding one or more private units of “Artila Tulum” and afterward for a maximum period of 5 years.
- 2. If you are a Prospect or Offeror, the retention of personal data will be for a maximum period of 2 years.
VIII. MEANS TO LIMIT THE USE OR DISCLOSURE OF PERSONAL DATA
If you no longer wish to receive information related to the non-essential purposes detailed in this Privacy Notice, you may, at any time, send a written request to the Data Protection Department at the offices of “Quiet Luxury - Artila” or an email to sales_tulum@quietluxury.com.mx requesting to stop being contacted for such purposes.
IX. CHANGES TO THIS PRIVACY NOTICE
This privacy notice is effective from July 2024 and may be modified, changed, or updated due to new legal requirements; our own needs for the products or services we offer; our privacy practices; or for other reasons. We are committed to keeping you informed about changes to this privacy notice, through the office of “Quiet Luxury - Artila”. The procedure through which notifications about changes or updates to this privacy notice will be made is as follows: the new privacy notice will be posted in writing at the offices of “Quiet Luxury - Artila” and will also be available on the website for the commercialization of the “Artila Tulum” Housing Complex. Once made available to you, and if you do not express your opposition to it, it will be understood that you tacitly consent to the processing of your data.
